Patent strengthening is the term that refers to the process of achieving the greatest potential for value from a patent during the prosecution – before a patent is even granted.
Events along the way during patent prosecution create multiple windows of opportunity for a patent, and therefore a portfolio, to be strengthened. Of course, the converse is also true. Patent prosecution provides strategic opportunities, but at the same time merely pushing paper and returning service to a patent examiner without thoughtful consideration can spell disaster.
At a high level, there are four factors to consider:
- Adoption of the innovation in the marketplace
- Identifying additional innovations to pursue
- Tuning applications to a company of interest
- Abandoning applications with concerns to conserve resources
